Court Ruling Affirms the Publication of Matric Results in Newspapers


MEDIA STATEMENT


Johannesburg, South Africa, Wednesday, 8 January 2024 - Public Interest SA welcomes the Pretoria High Court's decision to strike off the roll the Information Regulator's urgent application to block the publication of matric results in newspapers. This ruling clears the way for the Department of Basic Education (DBE) to publish the matric results for the class of 2024 on 13 January 2025, as planned.


The Information Regulator had argued that publishing matric results was in contravention of the Protection of Personal Information Act (POPIA). However, the DBE countered this claim, stating that it had not received a single complaint from members of the public regarding the publication of results. This long-standing tradition has been viewed by many South Africans as a matter of public interest and an integral part of celebrating the achievements of matriculants.


In what appears to be a gross misuse of public resources, the Information Regulator also imposed an exorbitant administrative fine of R5 million on the DBE, further raising questions about the motives behind its actions. To date, not a single pupil, parent, or guardian has joined the Information Regulator’s legal efforts, underscoring the lack of public support for this action.


Public Interest SA views this ill-advised litigation as an egregious abuse of the judicial system by officials pursuing personal agendas at taxpayers' expense. Such conduct diverts critical resources from addressing real challenges and undermines the credibility of institutions tasked with upholding the public good.


We call on the courts and oversight bodies to take a firm stance against such reckless litigation practices by public officials. Public funds must be directed towards meaningful programs and initiatives that benefit the nation, rather than being squandered on ill-conceived legal battles.


The publication of matric results serves as a source of pride and inspiration for countless families and communities across South Africa. Public Interest SA commends the Department of Basic Education for standing firm in its commitment to transparency and public accountability.
